Terms of Service

1. Acceptance of Terms

By accessing or using Tappzy ("the Service"), operated at tappzy.net, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Tappzy provides a link-in-bio page builder. Users purchase an annual subscription to create and customize a page with links, media embeds, and other content. The Service includes features such as analytics, email collection, link scheduling, digital downloads, tip jar, paid links, and media embeds.

Tappzy offers two subscription plans:

• Standard Plan — Includes all core features such as analytics, email collection, link scheduling, tip jar, digital downloads, paid links, animated themes, and media embeds.
• Business Plan — Includes all Standard features plus contact form, business hours, Google Maps embed, QR code, menu/services list, customer reviews, and a 0% platform fee on marketplace sales.

Features and plan inclusions may change over time. We will notify users of material changes via email.

3. Subscriptions and Payments

All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service.

Billing: Subscriptions are billed annually. Your subscription will automatically renew at the end of each billing period unless cancelled.

Cancellation: You may cancel your subscription at any time through the subscription management portal in your editor. Upon cancellation, your page will remain active until the end of your current billing period. After that, your page will no longer be publicly accessible. You may resubscribe at any time to reactivate your page.

Refunds: All sales are final. We do not offer refunds unless required by applicable law.

Free Trial: The Business Plan includes a 7-day free trial. A valid payment method is required to start the trial. If you do not cancel before the trial period ends, your payment method will be automatically charged the annual subscription fee. If payment fails at the end of the trial or the trial expires without a valid payment method, your page and all associated data (including subscriber lists, loyalty card members, booking requests, analytics, and uploaded files) will be permanently deleted. Deleted trial data cannot be recovered.

Cancellation During Trial: You may cancel your free trial at any time before it ends. Upon cancellation, your page will be unpublished immediately but will remain accessible to you until the end of the 7-day trial period. After the trial period ends, your page and all associated data will be permanently deleted.

Promotional pricing: From time to time, we may offer promotional or coupon-based pricing. Promotional rates are temporary and apply only for the specified duration. After the promotional period ends, your subscription will automatically renew at the standard rate unless cancelled.

Price changes: We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price increase takes effect on their account.

4. Account Access

Tappzy uses email-based authentication. You access and edit your page via a sign-in link sent to your email. You are responsible for maintaining access to the email address associated with your page. We are not responsible for unauthorized access resulting from compromised email accounts.

5. Marketplace (Paid Links, Tip Jar, Digital Downloads)

Tappzy provides marketplace features that allow page owners to accept payments from visitors through paid links, tip jar, and digital downloads ("Marketplace Features"). These features are powered by Stripe Connect.

Stripe Connect: To use Marketplace Features, you must complete Stripe Connect onboarding and agree to Stripe's Connected Account Agreement. Tappzy is not a party to transactions between you and your customers.

Platform fees: Tappzy charges a platform fee on Marketplace transactions. The fee depends on your plan:

• Standard Plan: 9% platform fee on each transaction
• Business Plan: 0% platform fee on each transaction

Standard Stripe processing fees apply to all transactions regardless of plan. These fees are set by Stripe, not Tappzy.

Payouts: Payouts are handled entirely by Stripe according to your Stripe account settings. Tappzy does not hold funds on your behalf.

Seller responsibility: You are solely responsible for the products, content, and services you sell through Marketplace Features, including compliance with applicable laws, fulfillment of orders, customer disputes, and tax obligations.

Digital downloads: Files uploaded for digital downloads are stored on our servers. We reserve the right to remove files that violate these terms or applicable law.

6. Contact Form (Business Plan)

Business Plan pages may enable a contact form that allows visitors to send messages to the page owner. Messages are delivered via email through our email service provider (Resend). Tappzy does not store contact form messages — they are delivered directly to the page owner's designated email address.

Contact form submissions are rate-limited to prevent abuse. Tappzy is not responsible for the content of messages sent through the contact form.

7. Appointment Booking (Business Plan)

Business Plan pages may enable an appointment booking feature that allows visitors to submit booking requests. Page owners can confirm, decline, or cancel bookings. Customers receive email notifications when their booking status changes.

No guarantee of service: Tappzy facilitates the booking request process only. We do not guarantee that any appointment will be honored, fulfilled, or performed. The booking feature is a communication tool between page owners and their customers — Tappzy is not a party to any appointment or service agreement.

Cancellation: Both page owners and customers may cancel confirmed bookings. Customers can cancel via the link provided in their confirmation email. Tappzy is not responsible for any losses, costs, or inconvenience arising from cancelled or unfulfilled appointments.

Customer data: Booking requests collect customer name, phone number, and email address. Page owners are solely responsible for handling this data in compliance with applicable privacy and data protection laws. Tappzy stores this data to facilitate the booking process and does not use it for any other purpose.

8. Digital Loyalty Cards (Business Plan)

Business Plan pages may enable a digital loyalty stamp card. Page owners can stamp customers in-store using a dedicated stamp tool. Customers can redeem their completed card for rewards as determined by the page owner.

No guarantee of rewards: Tappzy provides the stamp tracking mechanism only. We do not guarantee that any reward will be honored or fulfilled by the page owner. The nature, value, and fulfillment of rewards are solely the responsibility of the page owner.

Rate limiting: Stamps are rate-limited to one per customer per 24-hour period to prevent abuse. Tappzy is not responsible for disputes between page owners and customers regarding stamp counts, reward eligibility, or reward fulfillment.

9. Event Pages

Tappzy offers event packages that allow organizers to create pages for event attendees.

Pricing: Event packages are one-time purchases priced by tier based on the number of attendees.

Expiration: Attendee pages are active from the event start date until 1 day after the event end date. After expiration, attendee pages are no longer publicly accessible. Attendees may upgrade to a personal subscription to keep their page permanently.

Bulk imports: For large events, attendee data (names and emails) may be submitted via CSV for bulk page creation. By submitting attendee data, you represent that you have the right to provide this information and that attendees have consented to receiving email communications related to the event.

Dashboard access: Event organizers receive a dashboard key that grants management access to the event. Dashboard keys may be shared with authorized co-organizers. You are responsible for keeping dashboard keys secure. Anyone with the key can manage the event.

Attendee data: Organizers are responsible for compliance with applicable data protection laws (including GDPR and CCPA) when providing attendee information to the Service.

10. Email Collection

The Service allows page owners to collect email addresses from visitors via a subscribe form. By enabling email collection, you agree to comply with applicable email marketing and data protection laws, including CAN-SPAM and GDPR. You are solely responsible for how you use collected email addresses.

11. Acceptable Use

You agree not to use the Service to:

• Post illegal, harmful, or fraudulent content
• Distribute malware or phishing links
• Impersonate another person or entity
• Harass, threaten, or abuse others
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Sell prohibited goods or services through Marketplace Features
• Use the Service to send spam or unsolicited communications

We reserve the right to remove any page that violates these terms without notice or refund.

12. Sensitive Content

The Service includes a sensitive content warning feature that allows page owners to display an age gate before visitors can view page content. If your page contains content intended for mature audiences (18+), you must enable the sensitive content warning. Tappzy is not responsible for verifying the age of visitors and does not guarantee compliance with age restriction laws in your jurisdiction.

13. Content Ownership

You retain ownership of all content you upload to your Tappzy page. By using the Service, you grant us a limited license to host and display your content solely for the purpose of operating the Service. This license ends when you delete your page or your subscription expires.

14. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Firebase (hosting and authentication), and Resend (email delivery). Your use of these services is subject to their respective terms. Tappzy is not responsible for the availability, accuracy, or conduct of third-party services.

Pricing information displayed on our website for third-party services (such as competitor pricing comparisons) is provided for informational purposes only, is accurate as of the date indicated, and may change without notice.

15. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted or permanent access. We reserve the right to discontinue the Service at any time with 30 days' notice to users via email. We are not liable for downtime, data loss, or service interruptions caused by factors beyond our control, including third-party service outages.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Tappzy does not warrant that the Service will be uninterrupted, error-free, secure, or that any content or data will be preserved.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAPPZY, ITS OWNERS, OPERATORS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF TAPPZY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies to, without limitation: failed or missed appointments, unfulfilled loyalty card rewards, failed marketplace transactions, lost revenue, email delivery failures, data loss, service interruptions, third-party service outages, unauthorized access to your account, and any actions or omissions of other users of the Service.

IN NO EVENT SHALL TAPPZY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO TAPPZY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TEN DOLLARS ($10.00), WHICHEVER IS GREATER.

18. Indemnification

You agree to indemnify, defend, and hold harmless Tappzy, its owners, operators, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any content you upload, post, or transmit through the Service; (e) your use of Marketplace Features, including any disputes with customers; (f) any appointments, services, or rewards you offer through the Service; or (g) your failure to comply with applicable laws.

19. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, at Tappzy's sole discretion. You agree to waive any right to a jury trial or to participate in a class action.

20. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page. For material changes, we will notify users via email.
